DESPITE POSITIVE AGREEMENT BEFORE THE FINANCIAL CRISIS HIT DOE RUN, MAJOR PROBLEMS HAVE YET TO BE SOLVED IN LA OROYA.

1. We consider it proper the way in which we are facing the economic and financial crisis of Doe Run Peru. This result was made possible mainly by the vigilance, pressuring and suggestions carried out by organizations, experts from civil society, and media.

However, it is necessary to make transparent the terms, conditions and agreements reached by the active parties, in particular regarding the Peruvian State. Likewise, it is necessary that the financial negotiations and operations protect the jobs of payroll workers as well as the complex metallurgical contract in order to avoid layoffs.

2. To prevent similar situations from occurring in other forms and in doing so affect local populations and regions, mechanisms of financial transparency must be established for the mining and/or metallurgical mining businesses. In this regard, we urge the Congress of the Republic to assume such legislative tasks.

3. What remains to be clarified is the status of the tax debt that Doe Run had with the state until 10/31/2004, which amounted to 154.4 million dollars. Since these resources belong to all Peruvians, Parliament is required, according to the established procedures for the ending of the secrecy tax, access to such information and to force the debt, demanding compliance.

4. Furthermore, we demand that the Ministry of Energy and Mining and OSINERGMIN inform the country about the degree of fulfilment of the obligations and commitments contained in the Ministerial Resolution 257-06/EM-DGM, which extend the deadline for compliance with the Programa de Adecuación Ambiental (PAMA), and about the actions that both institutions are taking in order to be up and running according to the established timeline. Therefore, we demand that no further extension is given, as it would once again have a negative effect on the health of the inhabitants of La Oroya.

We also demand that two independent audits, one economic and one environmental, of the PAMA projects are conducted after their implementation.

5. Finally, we do not consider it enough to simply have the compliance of PAMA, rather we seek to achieve a drastic reduction in emissions, to international standards, so that the people of La Oroya are no longer harmed, that environmental sanitation is conducted, and that proper medical attention is given to all those who have been affected.
